This is probably a natural lull time for a lot of judges... those who really wanted to jump start the process and interview/hire early have had a long time to do so, while those who prefer to wait and see only have a couple of more months to go. Throw in the fact that a lot of them are probably preparing for June/July oral arguments session and it's not hard to imagine why there hasn't been much activity this week on the 9th (or with any other court for that matter).

I agree with #45 that this is just a bad time for a lot of judges. A friend of mine clerking for a circuit judge (not on the 9th) who traditionally hires early said that s/he has not looked at any applications in weeks because of oral arguments coming up soon.

Most judges on SDNY hire way in advance, for instance several judges essentially hire 2 years in advance now (go look at all the 2011-12 postings for SDNY on OSCAR). Even those who hire more traditionally tend to be filled with alumni hires before 3Ls can even apply. To summarize, not many 3Ls get SDNY offers, even in more favorable economies.

If you're a student and all you did is finalize your OSCAR application, Pryor won't see it until the fed plan kicks in on Sept. 8. I don't think Pryor has ever waited that long to hire. [From OSCAR] "Please know that once your application is finalized, you will not be able to make any changes to your documents or recommender. Applications from 2009 and earlier graduates will be immediately viewable, whereas applications from 2010 graduates will not become viewable until Tuesday, September 8, 2009 "

You would definitely be a shoe in for Veterans Administration Regional Counsel. They get off work everyday about 4pm, salaries start at about 52k or so. Not a bad gig. You could also do JAG if you aren't too old. Justice Department would also be an option. Maybe some former clerk will come on here and give us some insight. I highly doubt they would be on the blog though... anyone know a former clerk from the Court of Veterans Appeals?

As usual, that all depends. It's not an A3 court, and I think that does have some effect on its prestige, although the practical difference can be limited. I'd say that if you're interested in government contracts and tax, the CFC clerkship will carry weight in those relevant legal communities. Otherwise, a district court would probably be a better bet, both experientially and in terms of prestige.

Beyond Scirica it's very tough to rank based on prestige and you can make very strong arguments for Sloviter (great judge but reputedly horrible to work for), Barry (minor feeder), Rendell (reasons should be obvious), McKee (will be chief judge but not really remarkable beyond that) and Jordan (new but strong potential to feed in the future). If you don't get Scirica I'd feel about equally comfortable with any of the above.

Seems to be very difficult if you don't have a connection. When I was applying two years ago, I did not get a single interview in the ED Va despite getting interviews elsewhere including the 2d Cir. Wife's family in the Richmond area was apparently not a very good connection.

It's a desirable district and there are relatively few district court judges compared to SDNY, CDCA, NDIll, etc. I do know two people who did land clerkships on the EDVA. One was from Norfolk and went to William & Mary UG. The other had awesome credentials and clerked for C.J. Jacobs on the 2d Cir. after the EDVA clerkship.

A significant percentage of the D.Md. judges seem to be hiring alums this year -- Messitte, Titus, Chasanow, to name a few. There are certainly judges that hire 3Ls based on the Plan, but I think the trend is more toward alums at this point. With that said, if you're a 3L, don't lose hope and definitely still apply.

A tax LLM is a definite boost, but it's possible to get hired without one. I got hired with no tax LLM and only summer associate experience at a big firm. Know of at least one other hire with similar credentials. Bottom line, judges are looking for a commitment to tax. It's easy to demonstrate this with a tax LLM, but there are other ways.

Alexandria is certainly far more competitive than the other courthouses, and the cases are often more interesting (more cases involving political intrigue, etc.). Brinkema and Ellis tend to be the most competitive, and both seem to be good experiences. Also hear good things about Trenga.

Both Magistrate Judges Bush and Chief Magistrate Judge Dale have one rotating term clerk at this time. Chief Judge Dale's term clerk position is currently posted. DDC and SDNY are much more prestigious than the 8th Circuit; that's not a knock on the 8th Circuit, which is great, but those two district courts are better than most flyover circuits.

@89 I know a foreign student who managed to land a clerkship in a fairly competitive east coast district (think EDPA, EDNY, D.Mass, etc.). She did have a fairly prominent prof go to bat for her though. So I think the short answer to your question is that it's harder, but that it happens more often than many might think. HTH.

The above commenter is correct, but the Garland clerk is for 2011. All four 2010 clerks have been reported: YLS 08/Kavanaugh, HLS 09/Posner, HLS 09/Kozinski, UVA 09/Wilkinson. And then for 2011 there's HLS 09/Garland.

I was the original poster (use "Honorable" for all; use "Chief Justice of the United States" for Roberts; use "Supreme Court of the United States" for everyone else). This came from two current SCOTUS clerks. I don't see how using "Honorable" could hurt you (or "Mr. Chief Justice"). My guess would be that this choice is among the least important in your applications.

A clerkship with either Judge Fletcher or Judge Reinhardt would be an amazing opportunity. In the event you are making that decision, it should probably come down to dynamics in chambers. At that level of a clerkship, you can't really go wrong. If you're looking for "feeder" records, you might want to check out: http://en.wikipedia.org/wiki/List_of_law_clerks_of_the_Supreme_Court_of_the_United_States. It lists SCOTUS clerks with former clerkship annotations as well.

Fletcher strictly adheres to the hiring plan. Reinhardt doesn't; he's almost always finished by mid-summer. In other words, your hypothetical doesn't work. You would have had to make a decision on Reinhardt before knowing whether you would get an offer by Fletcher. Anyway, if you really are so exceptional to be able to choose between these two judges, then you can get better advice from professors and recent graduates of your law school than you can from this website.

I don't think it's possible to have an exact ranking of something like this, but I'd assume the most competitive clerkships are with Kozinski, Reinhardt, O'Scannlain, Wardlaw, and Berzon. All of the clerkships with active Ninth Circuit judges are very difficult to obtain, though.

I'd second that it's not possible to have an exact ranking, but I'd go off of the 'feeder' stats of the judges and then the geographic locations: 1. Kozinski; 2. W. Fletcher/Reinhardt; 3. O'Scannlain; 4. and then the SF/LA/Hawaii judges; 5. and then everybody else. The feeder stats are imperfect though. Like Kozinski has amazing feeder stats but the nature of his chambers may scare some people away, making them slightly less desired. And the same goes for Reinhardt.

Some chambers (Breyer, Ginsburg, Scalia, Thomas - I think) will send a letter indicating that your application has been recieved. According to the letter from Justice Ginsburg, if you haven't heard anything by August, you are not going to hear anything. For the rest, it seems less clear. Justice Scalia has scheduled some interviews for the 2011-2012 term, it seems Justice Breyer has too. There have been a few isolated hires (Roberts & Ginsburg with one each). Some have just finished hiring for 2010. My impression, though, is that most people who are ultimately going to be hired will have heard by sometime this Fall (if not before or already).

If you want to be considered for the 2011 term, you should get your applications in ASAP. Some justices will automatically reconsider applications in subsequent years (e.g., Justice Thomas). I am not sure, however, that this is widely practiced. It wouldn't hurt to reapply next year.

Clerks for retired justices tend to spend most of their time working for an active justice (as an additional clerks). Retired justices may sit by designation on any lower court in the country, and when they do, their clerk will generally assist them. I don't know about calling chambers, but you can always send your cover letter, transcript and resume, and indicate that letters of recommendation will follow (assuming that's what's holding them up). You can also include a list of recommenders with their contact information in case a justice wants to get in touch with them before the letters arrive.

The clerks will read through the applications. The justices will most likely not look at each one. If you're a viable candidate, then you will get a fair shake, even the justices are not getting personal phone calls on your behalf from a "feeder" judge. It can't hurt though.

The number of interviews varies widely by Justice. Ginsburg hires basically 100% of her interviews, so 4 for 4 spots. Kennedy interviews maybe 6 for 4 spots. Scalia interviews probably over a dozen, as do Roberts and Alito I believe.

But here is the thing, if you sent in your app like in March, I doubt they are going to dig it up and call you six months later in September. If you have not gotten a call already and it's been a couple of months since you applied, that's probably not a good sign. Unless you got a feeder judge calling for you, of course, to help take your app out of the pile.

I don't think the timing of your application is going to have much to do with it. The justices don't review applications on a rolling basis (i.e., making a decision on each within a specified time after submission). If you applied in March, for example, your application may be on a "short list" created by the clerks for a particular justice, but he or she may just be waiting until things slow down a bit more before making any decisions (including calls about interviews).

Echoing the last post, most applications are just filed away. Some screened as they come in, some not until the justice wants to start reviewing. All you have to do is scroll up and see that a bulk of the action takes place in September-November of each year--both calls for interviews and actual hiring.

The length of time since your app was sent has nothing to do with with whether or not you will get a call; once received, it will be reviewed when the justice starts moving.

What I meant was that Justice Thomas is the member of the Court most open to hiring clerks from law schools outside the usual suspects. If the previous poster has done really well at a school outside that group, then Justice Thomas would be the natural choice. But, there are other criteria based on which a judge might select a clerk or an applicant might select a clerkship. Someone who is very liberal, for example, might not be that interested in clerking for Justice Thomas, even if he is the justice most likely to consider a candidate from his school. I don't purport to know what his hiring criteria are. I was just reserving the possibility that (a) he likes to hire clerks who have done exceptionally well at schools that don't tend to produce Supreme Court clerks and yet (b) applies at least some additional criteria. What do you think I meant?

Another relevant (and relatively transparent) criterion for Thomas is experience: he almost always hires clerks two or more (sometimes many more) years out of law school, and hasn't hired a clerk coming straight off an appellate clerkship in five years or so. At least two of his recent clerks have done two appellate clerkships (and one also did a district clerkship), but he seems to prefer (or perhaps even require) some additional, intervening experience.

Not all of the chambers send letters (or postcards), but I'm pretty sure that those who do send them to everyone. Thus, people who got calls probably did get letters (assuming the justice in question sends them), but everyone will get letters that don't turn into calls.

NYU's clerkship manual shows the past clerks for the 4th circuit as having the second highest GPA range and average (after the D.C. circuit). it is significantly higher than the 9th and 2nd circuits (by significant, i mean like .05-.1, which is a lot). why is it so hard to get a 4th circuit clerkship? it can't be wilkinson, b/c he's rarely taken from nyu (if at all).

It depends on who you are clerking for. Best thing is to wait and see what the mood is like when you arrive. You can always call chambers in advance to ask questions if your plans can't wait, but you risk setting a red flag, again depending on your judge. I am not an employee of the judiciary, so my answer is nothing more than an opinion, but I think SDWV would fall under Rest of US. The lumping of WV-DC-MD-PA-VA suggests to me that they are referring to the DC Metro area, which tends to include the eastern panhandle of west virginia. So, in my opinion that rate of compensation would include NDWV court sitting in Martinsburg, WV, but would not include any courts in SDWV
