Now that we are about a month and a half before the official start of the 3L rush, it is a pretty good time to examine the state of pre-plan hiring.


Let's start with the bad news (well, for 3Ls at least): a whopping 47% of active federal court of appeals judges have engaged in at least some pre-plan hiring activity, with 20% of all COA judges being either completely done with hiring or not hiring at all.

On the bright side, it appears that senior COA judges have thus far been somewhat less likely to snatch applicants early (that, or senior judges and/or their applicants are less likely to report hiring events).

Of course, you don't know how much of the "known" slices should actually be in the interviewing/hiring/done categories.

All this data is based on what's in the LCA database, which is based on 1) hirings confirmed through OSCAR and 2) rumors/tips submitted to this site. While it's likely that some of the tips we get are inaccurate, I think in the aggregate the underreporting greatly outstrips the overreporting. So, my personal guess would be that 47% is a minimum, and realistically it's probably closer to 55-60%.
