Kleinfeld has a special dispensation to interview a couple of weeks before everyone else because of his location in Alaska. I find it hard to believe he went off plan after trying so hard to make the plan work for him.

The guy who reported the Kleinfeld interview is an alumni applicant, so technically Kleinfeld wouldn't be going "off plan" by interviewing him, since the plan's timetable only applies to law student applicants.

Don't know anything about his specific practices, but the Hawaii threads on the forum indicate that getting any clerkship based in Hawaii is extremely difficult. After all, who wouldn't want to clerk in paradise?

I would guess the 2009 reference was gratuitious and she is interviewing all alumni. But, if she wanted to say that, she could have just said law graduates instead of 2009 law graduates. Odd since I don't think Nelson had a reputation for being anti-WE.

I'd imagine that Smith means what he says about law review. That said, it takes about 30 seconds to send him an Oscar application, and you might even try to use your cover letter to explain why your non-law review experience shouldn't DQ you.

This is probably a natural lull time for a lot of judges... those who really wanted to jump start the process and interview/hire early have had a long time to do so, while those who prefer to wait and see only have a couple of more months to go. Throw in the fact that a lot of them are probably preparing for June/July oral arguments session and it's not hard to imagine why there hasn't been much activity this week on the 9th (or with any other court for that matter).

I agree with #45 that this is just a bad time for a lot of judges. A friend of mine clerking for a circuit judge (not on the 9th) who traditionally hires early said that s/he has not looked at any applications in weeks because of oral arguments coming up soon.

Kleinfeld is off plan. He's explained why in Howard Bashman's "How Appealing" blog. http://howappealing.law.com/20q/2003_05_01_20q-appellateblog_archive.html#200242242 "I don't follow the law clerk hiring plan, because it is impractical for Alaska. I hire before, during, and after the officially stated times. As a practical matter, I now expect to do much of my hiring during the summer following second year and during the fall of third year. Applicants applying in advance of the law clerk hiring plan shouldn't wait on recommendations from their professors before sending applications. "The reason I don't follow the plan is that it would be too great an imposition on an applicant to make them travel to Fairbanks, Alaska for an interview, so I squeeze in a very few interviews when I am Outside on calendars. Often the interview is a long dinner at a good restaurant. The timing of my calendar trips and the sparseness of interview slots requires that I spread them out more than the hiring plan allows for. Also, I make better judgments on whom to hire when I can spread out the decisions and hire the law clerks one at a time."

This notion that Judge Wardlaw "fired at least one clerk a year" is ridiculous; while there was talk on another blog years ago about her management style, my understanding (though I could be wrong) is that in over ten years on the 9th Circuit she has fired one clerk and had one other leave voluntarily. I believe all of the gossip about her being difficult to work for dates back to that period, and (even if it ever did) no longer has a basis in fact.

As I understand it, the letter/email was to 2010-11 applicants, asking if they'd like to be considered for 2011-12. If you applied for 2011-12 in the first place, there would be no reason to contact you yet. You're probably OK still.

MDS had one non-primary LR clerk in his first (2006-07) class of clerks. He has called at least two other applicants for interviews since then who were not on primary LR. Although one of his former clerks tells me that he is "pretty serious" about the requirement these days, it doesn't seem to be hard-and-fast.

A clerkship with either Judge Fletcher or Judge Reinhardt would be an amazing opportunity. In the event you are making that decision, it should probably come down to dynamics in chambers. At that level of a clerkship, you can't really go wrong. If you're looking for "feeder" records, you might want to check out: http://en.wikipedia.org/wiki/List_of_law_clerks_of_the_Supreme_Court_of_the_United_States. It lists SCOTUS clerks with former clerkship annotations as well.

Fletcher strictly adheres to the hiring plan. Reinhardt doesn't; he's almost always finished by mid-summer. In other words, your hypothetical doesn't work. You would have had to make a decision on Reinhardt before knowing whether you would get an offer by Fletcher. Anyway, if you really are so exceptional to be able to choose between these two judges, then you can get better advice from professors and recent graduates of your law school than you can from this website.

I don't think it's possible to have an exact ranking of something like this, but I'd assume the most competitive clerkships are with Kozinski, Reinhardt, O'Scannlain, Wardlaw, and Berzon. All of the clerkships with active Ninth Circuit judges are very difficult to obtain, though.

I'd second that it's not possible to have an exact ranking, but I'd go off of the 'feeder' stats of the judges and then the geographic locations: 1. Kozinski; 2. W. Fletcher/Reinhardt; 3. O'Scannlain; 4. and then the SF/LA/Hawaii judges; 5. and then everybody else. The feeder stats are imperfect though. Like Kozinski has amazing feeder stats but the nature of his chambers may scare some people away, making them slightly less desired. And the same goes for Reinhardt.

It's impossible to tell. They could send it out to everyone, or just people with grades above a certain threshold. If they were really specifically interested in your personally, they probably would have called or sent a more personalized email. But it's a better sign than nothing!

The only one I know of who takes applications from 3Ls before the hiring plan is Kozinski. Maybe also Reinhardt - not sure about that. But many of the judges hire alumni before the hiring plan kicks in, which is why there aren't all that many 3Ls who clerk on the 9th Circuit.

it seems like the 9th circuit is really getting off to an early start. Callahan is done for 2011. Silverman is presumably done with 2011 and has started for 2012. McKeown has started for 2011. MDS is done for 2011. perhaps the recession will make district court clerkships a de facto prerequisite for the majority of 9th circuit clerkships (since the 9th circuit is almost a year ahead).

It depends on who you are clerking for. Best thing is to wait and see what the mood is like when you arrive. You can always call chambers in advance to ask questions if your plans can't wait, but you risk setting a red flag, again depending on your judge. General advice: consider your time his/hers for the next 365 days starting in the fall.

Unless you know the judge is hiring (a few are already on OSCAR, I think), I'd wait until they post OSCAR openings this fall. Otherwise your application might not even get looked at. Last fall, about 30 circuit judges posted 2011 openings. I'd start mailing applications to judges who haven't posted in late spring 2011.
