Garland completes his hiring at approx. 9 am on the first day of hiring. You, like everyone else, have seen Garland's feeding record and want to clerk for Garland. Garland can essentially pick any moderate-to-liberal 3L in the nation as his law clerk, so he only calls basically the top 2 students from Harvard, Yale, and Stanford, and perhaps one student every five years from Columbia or Michigan. In summary, if you haven't heard from him, you will not hear from him.

One reason the D.C. Cir. is quiet is that at about half of the 2011-12 clerkships were filled earlier this summer or last fall. Tatel has only one opening; Sentelle two. Similar situations in other chambers, with all of the senior judges long since done hiring. As a consequence, lots of people who have interviews this week will either be shut out or shifted over to 2012-13.

How helpful is it to have experience first clerking at another Court of Appeals to get a clerkship at DC Circuit? Would it make me a very strong candidate or would judges not really care? Assume I would otherwise not have a very good chance at DC Circuit.

Prior experience will help with some judges (e.g., Williams) and hurt with others (e.g., Ginsburg). There seem to be a few people every year who do D.C. Cir. as a second COA, however, so on the whole the prior clerkship probably helps a little in most cases. A strong district court clerkship might be as good, though--Tatel's current OSCAR listing certainly implies as much.
